Your use of Trillusion Media, Inc.'s GiftCards App is subject to these Terms and Conditions, our Privacy Policy, and Apple's terms of use regarding third party apps, excluding any provisions in those terms of use that renders those terms of use inapplicable in the event of our own terms and conditions.

The GiftCards App allows you to purchase gift certificates from GiftCertificates.com, a third-party provider, and to manage those gift certificates. Your purchase and the use of those gift certificates is subject to these Terms and Conditions, and the terms of use and privacy policy of GiftCertificates.com, which you should review prior to your purchase.

(If we are able to (and do) actively update the GC terms of use and privacy policy) The terms of use and privacy policy of GiftCertificates.com can be found in the My Wallet section of the App.

(If we are unable (or do not) actively update the GC terms of use and privacy policy) It is your responsibility to review the GiftCertificates.com website for any updates to the applicable terms of use or privacy policy. Trillusion Media, Inc. is not responsible for any changes to those terms of use or privacy policy.

TO THE EXTENT ALLOWED BY APPLICABLE LAW, TRILLUSION MEDIA, INC. MAKES NO WARRANTIES WITH RESPECT TO ANY GIFT CERTIFICATES OR OTHER PRODUCTS PURCHASED BY YOU THROUGH THE GIFTCARDS APP, WHETHER EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE (INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR WARRANTY ARISING OUT OF COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE).

TO THE EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES IS TRILLUSION MEDIA, INC. LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE GIFTCARDS APP OR YOUR PURCHASED GIFT CERTIFICATES OR OTHER PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ACTUAL AND DIRECT DAMAGES HEREUNDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU, OR $500, WHICHEVER IS LESS.
